Inhalt: | Cette thèse propose l'édition critique, la traduction et le commentaire linéaire d'un traité de théorie juridique d'Averroès, intitulé 'Ce qui est nécessaire à l'étude des principes du droit'. Celui-ci se présente sous la forme d'un abrégé de la somme théologico-juridique d'al-Ghazâlî, 'al-Mustasfâ min 'ilm al-usûl'. Le premier volume de la thèse débute par une introduction textuelle suivie d'une introduction doctrinale où sont analysés en trois chapitres les grands thèmes de l'oeuvre : la fondation du texte révélé qui passe par une théorie du miracle et du témoignage par voies multiples (tawâtur); la théorie de l'interprétation à travers le concept de 'zann' tel qu'il apparaît chez les deux penseurs; les enjeux politiques et éthiques du 'Mustasfâ' et de l''Abrégé'. Enfin, le premier volume contient l'édition du texte arabe établie à partir du seul manuscrit dont on dispose (Escurial MS 1230), en vis-à-vis de la traduction française annotée (choix de traduction et d'émendations). Le second volume de la thèse est entièrement consacré au commentaire linéaire par paragraphe de l'oeuvre. Nous avons tenté de restituer l'argumentation à travers une comparaison systématique avec le 'Mustasfâ' dont nous avons traduit les passages pertinents pour notre commentaire. Nous avons également comparé certains passages avec les autres uvres plus philosophiques d'Averroès, particulièrement celles de la même époque. L'objectif du commentaire est double : revoir l'opposition classique entre Averroès et al-Ghazâlî sous le prisme de la théorie juridique et contribuer à décloisonner les disciplines religieuses (usûl al-fiqh, kalâm) et philosophiques au sein du système rushdien This PhD dissertation proposes the critical edition, the translation and the linear commentary of a treatise of juridical theory, (usûl al-fiqh) written by Averroes : «The Necessary in the Principles of Law ». It is a summary of the theological and juridical summa of al-Ghazâlî, 'al-Mustasfâ min 'ilm al-usûl'. The first volume starts with a textual introduction which answers a series of questions about the text, followed by a doctrinal introduction in three chapters focusing on key-aspects of the text : the foundation of the revealed Law based on a theory of miracle and of the multiplicity of the chains of reports (tawâtur), the theory of interpretation via the concept of 'zann' as it appears in both two systems, and a last chapter which examines political and ethical issues of the Mustasfâ and its Summary. Then we can find the edition of the arabic text based on the sole existing manuscript of the text (Escurial MS 1230), faced with the French translation with footnotes (precisions on translation and emendation). The second volume is entirely dedicated to the linear commentary of each paragraph of the text. The systematic comparison with the 'Mustasfâ', of which relevant excerpts are translated, restitutes the argumentation of the text. Comparison with other philosophical work of Averroes, namely those of the same period, was carried out. The commentary has a dual objective : to reassess the classical opposition between Averroes and al-Ghazâlî within the perspective of legal theory, and to highlight the interplay between religious and philosophical disciplines within the Rushdian system |
